I,
, the enrolled participant and/or parent/legal guardian of the participant agree and understand that swimming is a HAZARDOUS activity. I also recognize that there are risks inherent in the sport of swimming including but not limited to paralyzing injuries and death.
The participant and/or parent/legal guardian of the participant hereby agrees to participate in the swim lessons and other aquatic activities and hereby agrees to indemnify and hold harmless FIVE STAR FITNESS & AQUATICS LLC. its instructors, coaches, managers and employees against any liability resulting from injuries that may occur to the participant while participating in swim lessons and other aquatic activities. The participant and/or parent/legal guardian of the participant also agrees to indemnify FIVE STAR FITNESS & AQUATICS LLC, for any damages incurred arising from any claims, demands, action or cause of action by participant.
DESCRIPTION OF SERVICE All lessons are 30 minutes long and taught in small groups. Group classes have a 3:1 ratio and Seahorse classes have a 6:1 ratio. Skill level is determined by the instructor. Students can advance to the next skill level when they have mastered the skills outlined for their current level, as evaluated by the instructor. Number of lesson it will take to master each skill is different for every individual student. Parents are able to watch, but can only enter the water during seahorse classes. Parents should keep interaction with students to a minimum. Class days and times are subject to change. The schedule varies from session to session and we cannot guarantee your day or time will remain the same after the current session ends. Yearly customers must choose their day and time prior to the start of the session.
NO REFUNDS No refunds will be issued for any reason. This includes, but is not limited to: family vacations, religious holidays, schedule changes in other activities, illness/injury of a family member, bad weather, parties, sporting events, etc. If you need to withdraw from the session, a withdrawal form must be filled out by the parent/guardian. Withdrawal is only complete upon receiving the form signed by the parent/guardian of the student. A facility credit may be issued for remaining lessons at the sole discretion of the manager.
CODE OF CONDUCT All persons on premises are required to conduct themselves appropriately. This includes, but is not limited to, swim students in the pool, children outside the pool, and parents/guardians, whether in the pool, in the pool area, in the locker rooms or any other common area. Five Star Staff is not responsible for children after their lesson is completed. Students are not allowed in the pool prior to the start of class. Parents/guardians or siblings are not allowed to enter the pool during classes, except during Seahorse class when one parent/guardian must accompany the child. Running, throwing, yelling, biting, hitting, and other disruptive behavior is not permitted. Parents/Guardians are required to monitor their children and support this policy the entire time they are on premises. Students not following this code will be asked to sit out for a portion of class time. If disruptive behavior continues, the student will be removed from the program and all fees paid will be forfeited. There are no exceptions to this policy. Parents are not permitted to leave the building during the childs lesson.
MAKE-UP LESSONS Make-ups are limited to two for students enrolled in 7 or more lessons. Make-ups are limited to one for students enrolled in 6 or less lessons. Make-ups must be made up during the current session, cannot be carried over, and are not guaranteed. Make-ups cannot be rescheduled. Missed make-ups will result in forfeiture of that class. Make-ups for the last day of the session can only be done prior to missing the class. Make-ups may be scheduled in person or through email. It is your responsibility to schedule your make-ups. We can schedule only 10 days in advance. Students who are enrolled in semi-private lessons can only schedule make ups in group lessons, unless both students make up at the same time. If a class is missed for a medical reason, you may be eligible for additional make-ups. A valid doctor’s note is required to receive excused make up(s). Doctor’s notes are approved at the sole discretion of the manager. Additional make-ups are NOT given due to illness/injury incurred by family members of the swim student(s), with the exception of seahorse participants.
INSTRUCTORS We cannot guarantee any requests made for instructors. We try our best to keep the instructor consistent for the entire session, but due to sickness, vacations, emergencies, scheduling issues and other reasons, we cannot guarantee that the instructor will remain the same for every class. We cannot guarantee make-up classes will be with the instructor you normally have. This instructor policy includes all group, private, and semi-private lessons.
SWITCHING CLASSES Once the session begins, each student is only allowed to switch the day and time of their lesson one time. The switch is final and must be done in person. This does not include being moved to a different swim level. In order to switch classes, you must consult with the office to ensure there is a space in the new class.
PHOTO RELEASE/CONSENT You may opt out of the photo release by leaving the box blank. I hereby give Five Star Fitness & Aquatics LLC permission to use pictures taken of me or my child while on the premises for any reason. This includes but it not limited to advertising, newspapers, magazines, and/or social media.
